QUESTIONS

  • My ex-wife and I were divorced in 2010 and our dissolution documents were very vague concerning my military retirement. It states that "each of the parties shall be awarded, a division of their respective share of military retirement accumulated between the date of marriage and date of separation." Since there was no percentage or amount specified, she is now trying to file a new Domestic relations Order in order for me to give her a portion of my retirement. What can I do in order to make sure it is divided equitable and fair, so I do not get steamrolled in this matter?
  • My roommate flaked out on me and I need to pay a termination fee for the apartment. We are both signed on the lease but I need to know if my roommate is also responsible to split the termination fee and if so, what if my roommate refuses? Will she be responsible for paying her part? The termination fee is four months of rent and I am able to pay two (half) of the overall fee. My landlords said if she won't pay her part, it will be sent to collections and they will also require me to pay the remaining balance if she doesn't.
  • Am I still responsible for my rent if the house is unlivable due to a fire? Does the landlords insurance cover the rent? Would my rental insurance cover the rent?
  • how long shoud they give before i have to be out of the house?
  • How many days can a contract be cancelled?
  • This is an odd question for Arizona, but in the summer my landlord keeps the thermostat locked when he is in town. He is a rather large man, and keeps the A/C at 69 during the summer. Myself and my roommate nearly have to wear winter garments to be comfortable. Not only is this a waste of electricity, but it is extremely uncomfortable for his tenants. Is there anything I can do about this? Legally.
  • As the custodial parent, what can I do about a company not sending court ordered child support payments from there worker, the non custodial party?
  • My proprty is seduced to be sold today at a Trustee's auction. I had a new loan approved for past two weeks that would pay the existing note in full, the trustee deliberately withheld the final payoff statement until 4:59 p.m. on the day prior to the foreclosure, making it impossible to fund on the new loan in time to stop the sale. Is there anything we can do to stop the sale and buy ourselves a few days to get the new loan closed?
  • Is there a statue of limitations on custody papers? Can they be ammended at any time? is there a penalty for not seeing your child for over a year? I have attempted to see my son many many times but his father is not enforcing the custody papers. Do I have legal action against that?
  • On the month of April the rent was sent out and i was having trouble gathering the rent money because I got layed of for covid-19, but I didn’t know that the landlord wasn’t charging any late fees I didn’t get any letter no notice, nothing I found out by a neighbored still paid it by my 5 day window. Then the last week of April I didn’t receive the rent bill no one in the parking lot did. But the landlord said she did send it out, we all know she didn’t so I waited a few days the 6 th day I get the rent with late charges but didn’t get the normal rent bill in the first place can she do that?
