QUESTIONS

  • I am renting a house and the lease states renters are responsible for "yard maintenance." A storm broke 3 large branches on a tree in the backyard, one of which is laying on the patio canopy. The landlord said "I am responsible for yard maintenance. They will pay for any damages." I believe a tree nearly destroyed by a storm is different than yard maintenance and the landlord should have the branches removed and make the determination as to whether the tree should also be removed. Is it legal for them to force the cost of this clean up and potential tree removal on me?
  • Our rental home has a termite infestation and it's been over a month and our landlord has done nothing about it. What rights do we have? I've been told by our property management company that termites do not qualify under any law to terminate our lease. Are we stuck living in this house?
  • I left an abusive marriage in another state 16 years ago. My husband has died. This was a second marriage so I want to go back to the name prior to this marriage since I have adult children with that name and plan to be buried with the first husband. What will I need to proceed with this name change.
  • My Park charged me a $5 per day late fee on unpaid late fees. Is this legal in Arizona? The park applies any payment made to the amount due, thus guaranteeing that any payment made that is less than the entire amount owed will be subject to late fees for the entire time additional money is owed. I believe there are laws preventing that practice for mortgages but I'm unsure about rentals or leases. Shouldn't payments first be applied toward the monthly rent or lease and then any additional payment be applied to late fees? And isn't it illegal to charge interest or fees on late fees?
  • If neither party has received welfare what interest does the state have?
  • I signed a plea agreement in superior court, can I change my mind?
  • What parental rights do I have as a non-custodial parent. The custodial parent refuses to inform of medical conditions, medical and dental visits, school functions (states I am forbidden to attend), parent-teacher conferences, open house at school, basically he believes I am not permitted to have any form of contact outside my ordered visitation time - Saturdays 7am - 6pm?
  • My daughter has sexually assaulted a child. Is there a way I can give custody of her to the state for her to get help. I have already tried counseling and other options. Plus my girlfriend has moved out and refuses to let me see my son while I still have my daughter.
  • My parents kept seeing maks on my body assuming it was from being beat when really it was from aggressive sexual activities with my fiancé. Even though I told them it wasn't abuse I was embarrassed and afraid to tell them otherwise, so when they filed a report against my fiancé stating that he was hurting me and after I begged them not to do so they made it seem like they had already picked him up and took him in so when I spoke to the officer I was extremely distraught and went along with it anyways. He faces a hearing is there anyway I can stop this from happening,
  • My daughter lives in Northern AZ and had a child and lived with the father for 7 years. The relationship ended with the father filing custody papers with both parents having equal time with the child. He never has paid child support with my daughter never asking for it. He has been in several relationships with women married and divorced along with moving 10 times within 1 1/2 years. Long story short, my daughter has provided her with a stable home. He has hired a lawyer, she can't afford one. She has used legal aide but they won't go to the hearing. I'm worried she will loose wo/ a lawyer.
