  • How are custody issues decided?
  • I am currently paying my arreaarages for child support, but was awarded to claim my daughter in odd years. In 2005, she would not let me take the deduction and again this year; telling me because I am not current that I cannot claim her. Is this true? If yes, what is the statute? If no, what steps do I need to take that she is not following a court order?
  • My grandfather is 91 and not expected to live much longer. He has a house valued at 60K but he owes 50K on it. The house is deeded to "the trust of..." Who gets the house upon his death and also, who is responsible for maintaining the payments? I am the executor of his will and current POA for him but there is no special provision regarding real estate. He does have a trust set up and we only have the "abstract of trust" that states who the trustee is upon his death.

  • I belong to a Property Owner's Association. The manager and the original Developer states we do not follow ARS Title 33 because the Association is a non-profit corp. and does not own property. We are all mandated members that must pay dues to maintain the roads that are dedicated to public use. We have bylaws, CC&R's. Is this true? The developer is getting properties back thru foreclosures and says he does not owe dues and is using his 10-1 votes from the foreclosures. Our CC&Rs say that if the first mortgagee gets property back they are not liable for past dues, but from acquisition. Help?

  • Summary: My landlord sent me a notice to vacate from the residence using a text message. Is a text message a legally binding notice to vacate? Full: I have been a tenant for 4 years at the residence. My lease expired July 13, 2018. We did not renew the lease this year, so I've been paying month-to-month. I got a new out of state job and scheduled the movers for July 13. She suddenly sent me a text message on May 30 to vacate by July 1. She did not give me notice that she was looking for a new tenant. I have never been late or delinquent on rent payment. What are my legal options?

  • So my vehicle was towed in a free parking spot in my townhome complex. I know that within our HOA rules my vehicle was parked for a period of time so they had the right to tow it. One issue that we have is that there are not enough parking in our complex at all. It is a complaint all residents have. They have made parking available as if there are only families with one car per unit living in the complex, when there are residents that are renting the a unit and may have up to 4 cars per unit. I was wondering if there is a law that mandates a certain amount of parking for a complex?
