QUESTIONS

  • Is a condo covered in the anti-deficiency statue of Arizona? My condo is one of a 4 unit building. Is that a single family dwelling? I am the only person who lives in it. Can someone please help?
  • One year lease ended, converting to month to month lease, per provision in original lease. Landlord now says they want either a $300 fee to write a new lease or add a monthly $50 fee if month to month. There is nothing stated in original lease that either of these fees would be applied after the initial year ended. Is this legal?
  • If an order of protection is obtained, and an appeal was rejected. In the even the order is then modified and granted with the modification, does the order of protection get extended? For example: original order granted 11/12/2015, but was modified and granted 2/2/2016 is the new date 2/2/2016 or does remain the date of the original service?
  • Last year we fell behind on our home payments. We tried to work with the lender for months, Instead they set a foreclosure date. We only owe $265,000 plus the arrears on our home which is now appraising at $422k. We were forced to file Ch. 13 in order to stop the foreclosure and save our equity. My spouse now has a high income job offer out of state. We want to rent out our home instead of selling & dismiss the BK but still owe over $18k in arrears. With our bad credit due to the BK, what are our options for getting a loan to pay the arrears? Our home will rent for $2800 and our payment is 2k.
  • I understand there is a 48-hr required notice for showing a property occupied with tenants. If the tenant agrees says it is ok, is it ok to ask for an earlier showing, as long as I inform them that they are not obligated to allow it that early? Or would they still have legal recourse if they agree and is shown with less than 48 hr notice?

  • My brother and I had a verbal agreement that he would purchase my property in which I run my business from and live and we would then do a lease option to buy back with a set price being set at time of agreement and I would be responsible for making interest only payments on the money he borrowed to pay for the property, which was fine. However he has not provided me with any type of a written agreement, it is two years later and payment is quadruple what it was suppose to be and now he is trying to evict me and sell the property, do I have any rights?
