QUESTIONS

  • After eviction judgement is served, how many days must the landlord keep tenants personal effects in storage? when can the landlord dispose of the said tenants belongings?
  • My apartment complex has altered the equipment in the shower so that it lowers the water usage and the tenant had no say in this matter. Can they do this when the tenant signed a lease with the expectation of the existing shower?
  • We are renting our townhouse in another city in Arizona. We signed a 1 year lease with our tenant. The lease currently came up for renewal. Our tenant wanted to go month to month. We were not willing to do so, but said we were willing to shorten the new lease to 6 months. The tenant said (on the phone) that that would work for her. We drafted a renewal page, mailed it to her to sign. we included a prepaid, self addressed envelope. It has been several weeks, we have not received the signed renewal agreement yet We have called several times and she does not answer/return calls What should we do
  • My ex-girlfriend that lives in Colorado is claiming that I am the father of her 4yr old and asking for money. If he is mine want to give her money for the child but I also want to be able to see him. He was born in Texas and my name is not on the birth certificate. Can I file for a paternity test here in Arizona where I live? Or do I have to file for one in Colorado where the baby and mother live? Or do I have to file for the paternity test in Texas where the child was born?
  • My husband and I live in a mobile park, which the mobile home has been paid off, however the electric is connected to two other places plus ours that makes it three running under one electric bill.   • We have received numerous noise complaints. We addressed the issue multiple times. It was determined that the flooring was poor and that the plumbing in our apartment was broken (causes a loud banging anytime water is turned on). Leasing staff entered our apt. without permission and stated they discovered these things. We thought they found the source of the noise and would figure out a solution. Yesterday we received another 10 day noise complaint. My roommates and I are afraid of eviction and we aren't sure what the next steps should be.
  • Two weeks ago I had a discussion with my landlord and his wife about being two weeks late on my rent and would need to pay it on the 14th of November. They were kind and said that would be fine and to come in around rent time to fill out a promissory note. During that time and now his (the landlord's) wife left him because he was very abusive. Now Sunday Nov 2nd I went in to fill out the contract to pay on the 14th and the landlord said he was evicting anyone who had anything to do with her. What can I do I am a single dad with no family in AZ.
  • I understand there is a 48-hr required notice for showing a property occupied with tenants. If the tenant agrees says it is ok, is it ok to ask for an earlier showing, as long as I inform them that they are not obligated to allow it that early? Or would they still have legal recourse if they agree and is shown with less than 48 hr notice?
  • I was served a special writ for foreclosure due to being behind on HOA dues. How long do I have to try to pay the amount owed? It states my redemption period is 6 months. Is this from data of sale? Or from date I was served? Also, how long do i have before it goes to auction?
  • If I file a petition to modify child support in March can I change my payments immediately or do I have to wait to hear back from the courts?
