  • Does a restraining order stay on a defendant's record? If so, how long. The restraining order was for harassment. TA

  • My husband is homeless and does not really have an address. I mailed the acceptance of service plus the divorce papers to him at his last known addressvia certified mail. If I get the papers back unclaimed or undelivered can I file this along with asking for a default or do I have to go by publication? I cannot afford all these fees. I did get a deferral for the court fees but did not check for publication fees. Publication sounds like it is a hard and delaying process. I hear some saying I can file if I get the certified green card back as proof of service or even if the papers come back unclaimed. We have three kids and I am asking for sole custody.

There isn't any property involved or financial responsibility, and we both want the divorce. 1. Can I file for divorce without and attorney? 2.   • Concerning a Short Sale of Real Property; There are 3 liens. The 3rd lien is a voluntary one for the purchase of a home water purification system. In order to sell the property short, the Bank requires that the 3rd lien agree to be released. The lien holder is unreasonable. They ask for the original $4400 + Back Payments, Interest and Penalties which make the release amount about $10,000. Nothing less is acceptable. The Bank may allow 1 or 2 thousand dollars, no more. Can the 3rd lien be eliminated by an administrative action or through bankruptcy?
  • Does the following remedy mean that you are required to terminate lease and move out within five days if safety hasn't been restored?: "If there is a noncompliance by the landlord with section 33-1324 materially affecting health and safety, the tenant may deliver a written notice to the landlord specifying the acts and omissions constituting the breach and that the rental agreement will terminate upon a date not less than five days after receipt of the notice if the breach is not remedied in five days." Is there any other remedy? Can you withhold rent? Can you get alternate housing? Thanks.

  • I am a foreign national married to a US citizen and am currently preparing my immigration package to become a permanent resident. For the affidavit of support I got a bank statement showing payments from my main source of income, but it contains a disclaimer from the bank stating that they do not guarantee its correctness. I am worried it might affect whether it is accepted as evidence. Could this disclaimer become a problem in the immigration process?
