QUESTIONS

  • I have been wrongly served an Injunction against Harassment (IAH) notice. I want to challenge this, but in the meantime, I also want to get a protection order against the plaintiff. Is it wise for me to do so? Also, I plan on challenging the injunction. Should I seek attorney counsel? Or should I represent myself at the hearing?
  • I have a 4 year old step daughter and her real father does not come around and hardly ever has but pays child support. She does not have his last name she has my wife's maiden last name. I am married to her mother and was wondering how I could go about getting some kind of guardianship over her or if I can legally get her last named change because I have been around since she was a baby and doesn't believe her last name isn't the same as mine. Thank you looking forward to hearing back.
  • My mother passed away 5 yrs ago. Estate has never been settled in probate or anything. My sister moved her son into the home that was willed to us. He pays her the mortgage payment and she makes sure everything is paid. Home is still in deceased mothers name. We had verbal agreement that he would also pay me $200 a month and isnt paying anymore. I want to settle in court due to no executor of estate. My sister assumed executor but refuses to settle. I want her to buy me out and I will sign off on estate and she can do what she wants. What can I do???
  • I have a signed lease agreement with two other undergrad college students. One has vacated the property and has requested that the Landlord approve a sub-lease. There is a modification clause stating that all party's must approve in writing any changes to the lease. Can the other roommate and the Landlord move anyone they want into the residence without the approval of the other two that are remaining? There is a sub-lease clause as well stating that a sub-lease may be granted with the approval of the Landlord.
  • We requested our landlord hold our last month's rent (lease was not being renewed) and she agreed. We moved out early and returned the keys. Are we still the legal tenants of the home? She is refusing to allow us to use the driveway to park a vehicle.
  • I married a 16-Year Old female (I was 23) last year legally with proper parental consent. I was curious to know what my guardianship/consent rights are when it comes to my spouse being served legal paperwork or court orders by anyone, including myself. She was not emmancipated before our marriage, and I've had to legally be there to sign on her behalf for reasons such as school signup and notarizing items, so I know that I have some consent.
