  • Does your (401K ERISA) remain exempt when filing BK7 if you pledged it as collateral to a private loan you made with someone?
  • My ex-girlfriend and I obviously separated and have not done any legal custody paperwork with our (she is the mother) two children (ages 3 and 1). The boys constantly stay at the house that I own and never go to their mothers. She only sees them at my house for the 40 hours that I work per week and that is it. Their addresses (including the mother's mail) all come to the house that I own. She has now grown upset and wants to take the children to some long distant relative in Colorado just because she is angry. I do have the 3 year old enrolled in a local Prescott Valley school as well.
  • I don't know if you can help us or maybe direct us to someone who can. KayKay Properties took over as managers of our apartment building. This is not an assisted living facility, but regular low income senior apartments. I am one of the original tenant and the other original tenants and we have gone through several managers. But this company has come in and is trying to dictate to us, change rules that make so sense and threaten with evictions. We have been told that none of our grandchildren under the age of 18 can spend the night with us anymore, if they do, we will be evicted. If someone is on medical marijuana they can't smoke it in their apartment, they have to leave the building and smoke in the parking lot. If they smoke in the building they will be evicted. We can't go to check out mail in our robes, if we do we will be evicted. They will spray for roaches, but we have to count the number of dead ones, and if they have to spray again we have to pay for it. If we don't pay for the exterminator, we will be evicted. If any of us are ill and need family or friends to help us, we have to let management know who they are, where they work and how much they make, if not...you guessed it, we will be evicted.   • I moved into a new upstairs apartment unit in May 2011. It is now June 2011. Everything is great, except I have downstairs neighbors who play loud music from 1 am-5 am. The music is soft enough, but the bass is extremely loud. It vibrates our beds, floors and walls. We have spoken with the manager, who says that she can do nothing. The police have come, (twice), and are sympathetic but because it seems to affect only me (the vibration is in the bedroom below me), they don't know what else to do. Can I break my lease? More specifically, I want to change units. Can that be done?

  • I lived in XXXXX apartments until June 2015. In June of 2015 I paid $406.17 to end my lease and my roomates and I signed a roommate release form saying that I was no longer on the lease. They moved out prematurely in August of 2015. Apparently a sum was sent to a collection agency for that apartment in 2016 and they included my name when they did that. I did not find out about this until I applied for an apartment for my daughter and I in May of 2017 and was denied because of this sum. I called the complex and was basically told that they cant help me. What can I do from here?
