QUESTIONS

  • My 35 year old son lives with me, but recently I've been having two problems. The first is he keeps his room so filthy, it's unhealthy. Clothes all over, along with food containers over r, which will lead to insect problems that I don't want in my home. The other problem, recently he has been bringing over a girl that I don't want in my house. She comes in and uses the shower, my hair and bathing products. She brings her dog, that is destructive. I normally have no problems with his friends, both male and female, but I don't trust her, I don't want her and her dog here. What can I do legally
  • I am in the process of evicting a roommate. I took it to court, and have to restart the court process because the 5 day eviction notice was not certified mail. She has left all of her things for about three weeks now. At what point am I legally allowed to move her belongings to put another roommate into her old room? And what would I have to do for her property to roll over into my possession, so I can legally remove it from my home or dispose of the items?

  • My air conditioning stopped working Friday night and I am being told that because it is not more than 81 degrees outside it is not considered an emergency, they also stated they don’t know how long it will be until they fix it because of the Coronavirus. How long do they have before they have to fix my air conditioner? I have 2 children and it’s very hot inside my home this is not okay.
  • My brother has had his ex-wife stay with him for about 3 weeks, she was never on the lease of the apartment, pays no rent, has no mail going to the apartment, nor does she have any utility bills. She is becoming increasingly abusive and was only supposed to be temporary. Will he need to evict her or can he just have her removed for trespassing? My brother is the only one on the lease.
  • I got granted temporary sole legal decision making of my daughter but during this case I got into a car accident with my other daughter, I was not the driver or passenger and had no illegal part in this accident. Now my daughters father is telling me he has temporary sole custody and I cannot see her at all. He has domestic violence and was told that sole custody was not an option in our case for him. He got a lawyer and we made a settlement so it would be easier for me because the accident ruined everything with my life and I signed it but she told us that we needed to get it notarized.
  • I have a Health Care Advance Directive from another state. Some of my friends say it is valid, others no. I suspect it is really up to the local hospital/doctor whether to honor it. Can you tell me if there is an AZ law that REQUIRES hospital/doctor to follow it? If so, can you tell me the law (statue??) that applies so I can refer to it if necessary? Thank you
