QUESTIONS

  • I currently have a 80/20 home mortgage. The first is with one lender and is a 30 year fixed. The second is with a different lender and is a 15 year balloon fixed. Does Arizona's non deficiency stipulation apply to both loans or just the first. I am concerned about foreclosing and then being pursued in collection by the second loan holder.

  • My landlord sent me a lease renewal notice that indicated the rent would go up. We had a verbal agreement last summer when I renewed that my rent would stay the same. When I told my landlord that I planned to renew but asked if my rent would stay the same, she sent me a non renewal notice for my lease. Does this qualify as retaliation?

If you do make a payment, we may later be able to bring an action to collect this debt because the payment May start a new statue of limitations”. Has SOL run out, can they collect money if I sell home, 1099?
