Question: is it at all possible to give a grandparent partial custody over my child. sort of putting her in the fathers position since he no longer wants to be in my childs life?
Answer:
Generally, custody is determined by looking at certain factors, as shown in ARS 25-403. Custody is also defined in ARS 8-101. Looking at ARS 25-401, it says that a child custody proceeding can be commenced by a number of people; including a person other than a parent, but only if the child is not in the physical custody of one of the child’s parents. See ARS 401(B)(2) .
Also, ARS 25-415 gives additional laws as to who can commence a child custody proceeding and when. Because custody can be complicated, it may be best to speak with an attorney. For possible legal aid options, click here.
