Visitation

Questions & Answers

Question: Is there a law in AZ that says a child of divorce doesn't have to go see his parent that he doesn't live with. Also, when I have my children for the little amount of time that I do, is it right that my ex-spouse is always trying to communicate with the children while they are with me? I only have them for a few days a month? The calls are just how are you type thing.

Answer:

Generally, if the other parent is entitled to parenting time by way of a divorce decree or custody agreement, that parent has the right to exercise visitation with the children accordingly.

With regard to the telephone calls, review the terms of your decree or parenting time agreement.  Generally, the other parent is allowed reasonable telephone access with the children when they are not in that parent's care.  If you believe the phone calls are unreasonable, and you cannot resolve the issue with the other parent, you may want to use mediation services.   Most Arizona superior courts offer mediation services to the public.
