Questions & Answers

Question: I own my trailer and rent a lot, I got behind in paying my lot fee so am being evicted. What point and time do they(park personel) have the right to go through and take my stuff?

Answer:

The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly.

According to ARS 33-1481 if a person owns a mobile home and is evicted from a mobile home space the landlord may request a writ of restitution. If the writ is served the sheriff or constable "may remove all occupants and their possessions from the mobile home". This provision does not give the landlord the right to simply take one's stuff. If, however, if however the property is not removed it would be deemed "abandoned". The landlord would have to make arrangements to store it for a "resonable time", after which he could dispose of it. The owner of the property would be responsible for the costs of storage.
