Questions & Answers

Question: Hi, I am trying to get my security deposit back after two months since moving out, and I am preparing for a small claims court case. My question is: Can I use text messages in the small claims court case to provide documentation of what the other party said to me and to also help establish a timeline of events? If so, how should I go about doing this (bring the phone, print out the text messages from my phone, etc.)? Thanks!

Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directlyThere are no formal rules of evidence in Small Claims Court. It is a good idea to bring three copies of the texts (for the Court, the other party and yourself) and the phone with the original messages.
