Landlord and Tenant Rights and Responsibilities

Questions & Answers

Question: I had mold and filth in my A/C unit and gave the landlord 10 days to repair it. They did not and we were still sick so I gave my 30 days notice to move out. They refused to recognize they broke the law and is pursuing to charge me the early termination fees. Can they do that !!? Why won't the health department get involved in the mold situation?

Answer:

Carefully review the following articles on azlawhelp.org regarding Landlord and Tenant Rights and Responsibilities.  They may be helpful in answering your questions and providing direction:

 The Landlord Tenant Relationship (particularly: "Protecting your Rights" Section);

Arizona Residential Landlord and Tenant Act (particularly the section titled: "Other Noncompliance by the Landlord A.R.S. § 33-1361").

I have the same situation. Did you get anything resolved on this issue? I have hired a lawyer because my kids have been sick alot lately and I found mold in 5 of the 7 air vents in our apartment and our landlord doesn't seem to think its a concern!
