Question: My family and I have a lease for property. Today we received a notice taped to our door stating that there was going to be a "notice of trustee's sale" on the property. What rights do we have in this situation? Is this considered our 30 day notice to vacate? What action or responsibility does the management company have in this situation?
Answer:
A notice of trustee's sale is not the same as a notice to vacate. A notice to vacate may come after the trustee sale. However, you may want to begin to make plans to find an alternative place to live. A notice of trustee's sale as the house is going to be sold and it is most likely that you will be evicted by the company who purchases the house at trustee sale.
Based on your lease, the management company may bear some responsibility to you for the term of your rent. This would be dependent, however, on the terms of your lease. So it would be helpful for you to consult with a lawyer.
