QUESTIONS

  • Does a 20ft x 20ft area of sand filled with animal waste that is potent enough to be smelled 100 ft away count as a violation of implied warranty of habitability? The lease we signed said that we were responsible for the yard after 30 days but the smell is so strong we couldn't figure out where it was coming from until a few days after that time frame.

  • My debts, including my first and second mortgages were discharged in Ch. 7 bankruptcy in 2011. After BK, I contacted my landlord (BBVA Compass), to see if they would agree I stay in my house in exchange for reduced payments. They said OK, but said they couldn't provide me with any receipt or written communication of any kind. However, they are considering the second mortgage in the total owed, despite that debts like these are considered UNSECURED. Should I accept this agreement where I won't have a paper trail to rely on in case of a dispute later? Thanks!

As a minor, was his public school in violation of his rights to allow him to sign a waiver rejecting his right to an attorney or legal guardian to be present at his questioning and signed admission statement? Our son received and then sent to another student a nude picture of a girl who had generated and distributed this picture herself. The high school is calling this pornography and involved the sheriffs office in tracking down the kids who had hit send. Is this addmission statement, aadmissible in a court of law?

  • Me, my son, & my girlfriend we’re self help evicted from a verbal month to month agreement. Landlord provided no paperwork prior & changed the locks the same evening.   • I was arrested in 2013 for disorderly conduct per DV and was released the next day. I received a deferred prosecution for 6 months with no fine. The charges are now dismissed. Do I still have wait 5 years to expunge my record to work at a school? I was told by a co-worker who is a Lieutenant of the police department, that any DV charge has to be expunged before being able to work around children.

  • My ex is doing this to our son. Where can I get help? The judge doesn't see my side of this and there was significant domestic violence in our marriage. The judge has granted my ex custody and he is a dangerous alcoholic. My daughter, his step daughter is so afraid for her little brother because she knows 1st hand what her step-father is capable of yet the judge won't let her in the court room. My ex is extremely good at conning and manipulating the system and has the judge fooled. I don't know what to do and now I can't even see our son. What can I do?
