  • My landlord was intoxicated and assaulted me yesterday. I called the police and they came over, the cops asked if I wanted to press charges I said no, which I now regret. The officer asked if things would be ok if I left for the night and returned tomorrow. I stated yes and went to a motel for the night. When I returned home this afternoon he shows up with the police and a restraining order. I just paid him a months rent on July 1st, which he won't give back part off. Can I now press charges a day or two after and can I sue him for the rent I was screwed out of? He assaulted me... Help!!
  • My child is almost 6 months old, the father left when I was 9 weeks pregnant and has never expressed interest in our child (not wanting to see our child, not asking questions about our child, and not helping with support). He is not on the birth certificate and we haven't done paternity and he had agreed to terminating his rights when my child was born. Can I get his rights severed based on abandonment? Do I have a good case for severing his rights?
  • I'm looking for some guidance regarding the AZ Real Estate Recovery Fund. I submitted a claim against the fund some time ago but it was denied for multiple reasons, all of which were inaccurate. I'd like some advice from somebody with experience with getting reimbursement from the fund. The basis of my claim is the fact that my property manager embezzled security deposits and when his scam ran its course, he committed suicide. The fund is clearly setup to help those who have been a victim of real estate fraud, but the commissioner weaseled her way out of my claim on technicalities.
  • I received a an eviction notice last week giving me days to vacate. I had my boyfriend and dog move in and tried to have him added to the lease. He was denied. They also claim noise, but is is a second level apartment was laminate wood floors. They told me to put rugs down and walk on the balls of my feet. My boyfriend and his dog left. Im packing and they are saying I owe $5,400 at time of moving out. Im current on rent. they asked me to leave. Lease expires 01/30/2016. How can they charge me when Im current and they asked me to leave?
  • How long does a tenant have to file a lawsuit against a landlord for disposing of tenants property. My landlord disposed everything I owned for 30 years after I was evicted and forced to leave at a moments notice. 12 days later everything I owned was discarded without any notice to me. Is ther anything I can do.

  • I moved in the 4th of July weekend, signing a 1 year lease, which will convert to month-to-month after the 1st year. On 12/31/15 I received a notice that they were raising my "tax" amount effective 2/1/16 - is this legal? And once the lease becomes month-to-month and you agree to a rental amount increase (which is sure to come), do you legally have to sign the agreement which is the same format as a "1 year" lease? Is it also possible to receive a copy of the "Landlord/Tenant Handbook"?
  • If someone is on an Interstate Compact from Oregon to AZ and on parole, and they get put in jail; don't they still have the right to know why they've been put in jail? Especially after 3 weeks, with no appearance before a judge given, and Oregon says they still haven’t heard anything from Arizona and they usually don’t on these minor violations. I was told by a PO that my Son was being locked up for a parole violation of two diluted UA’s in a row. My son had to hear from me why he was locked up. They never told him his UA’s were coming out diluted or why he was being locked up.
  • I am obligated to indefinately pay spousal support, which I do not have the money for. The job position I was in has ended, and I am no longer in that field of work. Can the court require me to continue paying spousal support that I do not have the finances to provide?
  • My daughter's father and I have child support and visitation established, the court has left the visitation under our discussion, he and I decided on ones week him and one week for myself. I have enrolled our 4 year old in a preschool and I pay the full amount for our child to attend. Before I enrolled her I asked him if he would be willing to take her and pick her up from school. He agreed and now her wants me to take her out of school because he states it is not convenient for him to drive her back and forth to school, what are my legal rights and can he force me to pull her out of school?
