QUESTIONS

  • In the state of Arizona, can a person who has power of attorney or legal guardianship of a minor, attend a truancy hearing in the place the parent?
  • I am renting part of a unit where there are three other roommates. None of us knew each other. Landlord put us together as sudents. They party all the time. I cannot sleep or study. Can I get out of my lease. I cannot pay this rent and afford another place at the same time. If he serves eviction notice to all of us, do I still owe him the rent for the remainder of the lease. Other tenants are happy.
  • I'm on the board of my HOA and one of our new members is performing tasks around the property that are not authorized. He's even contact the City of Mesa police to have a vehicle ticketed on the property. When attempted to discuss the issue with the board member he became VERY hostile by verbal comments and threats. What actions do we as a board need to take in order to remove him? And is there any legal recourse that we need to abide by?
  • My wife and I moved into a rental home on 3/1/18 in Tucson, Arizona, and almost immediately my wife and I started having breathing problems when inside the house. We do not experience any of this when outside the house. Upon my inspection, I noticed black mold inside and out of the guest bathroom toilet. The management company sent their maintenance person who after getting clearance (1 week) they removed and replaced the toilet. The odor was abated for approximately 2 days and returned with the entire inside of the house smelling musty. It is more pungent in the laundry room and master bathroom. I have found mold in the master bathroom toilet on the inside. I went to the Management Company on 3/22/18 to advise them we continue to find mold in the house and my wife and myself are having breathing problems, mucus and headaches when we are in the home. We are having no issues when we are not inside the home and outside at work or living our active life style. and to see if they would look into this and was advised it was on me and I should hire a mold technician check it out. If mold is found then the Management company would move on it. Why would I have to have this expense, it’s not my house, we just moved in and I feel this is the landlords responsibility. Can you please advise if there is any action I might take that would not cost a large amount of money to get the management company to do their job and do due diligence on this issue. Also, if you know of any agency in Tucson that controls these types of issues between Tenants and their landlords/Management Companies please let me know. Thank you.

  • 3 days ago I signed a year long lease. Now, 3 days after singing, the rent price has dropped substantially due to Covid19. I am also being cut back on hours drastically at work. I am wondering if i have any rights for them to honor the current rent price or if I have any rights due to extreme financial crisis. Since I can’t work, I can’t get paid or pay my rent. My lease has a statement of Force Majeure but it seems that’s only beneficial for the landlord. Any options as to how I legally not be in trouble for missed payments or termination of lease?

I went to court with my ex we were never married he petitioned me and Showed up to court high in drugs. The judge ordered hair follicle tests I passed mine he never took his and than ended up going to prison for four years for aggravated assult on a police officer. I have supported them alone since before he went to prison. He has three other kids and all were taken by the state and adopted out due to his drug use. I want to place him on chikd support with no visitation. Can I?
  • I moved into an apartment complex nearly 6 months ago. 2 months ago they announced they will no longer accept payments at the office and the only choice is to use their online app or pay cash at a local Walmart. This was not in the lease when i signed it. The amount due is already pre applied on the app. 2 months of payments are submitted, no record on my account 2-4 days after the 1st. 3rd payment due, is less and unable to 'edit' for correction. I took screen shots of the process and says paid. No payment due for 27 days. I emailed the office about it.can they charge me fees for the error
