My Mother lived in and owned property in Sun City, AZ for about 30 yrs. She had two living children whom have had a rather toxic relationship. She had a living trust and her son is named Successor Trustee. In 2003 she suffered a small stroke and (while still mentally alert) she had a problem with her speaking ability. As a result, she retired as Trustee and named her son who divides his time between New Mexico and Alaska. Her son physically relocated her to New Mexico about 10 months before she passed in Feb. 2011. He had sold her property in AZ in Sept 2010 but moved all her personal belongings to his property in NM prior to that date. Her remains are interred in AZ. Which state would have jurisdiction if a probate proceeding is necessary? (i.e.- Say the Successor Trustee fails to act?)

I share joint custody of my son with my ex husband. We agreed to a parenting schedule at the time of our divorce 2 yrs ago. Now, I'm engaged and will need to modify the parenting schedule. Can my ex prevent me from moving 100 miles away to live with my new husband when our original order read "must remain 25 miles or less". I have a job lined up as well. I live in Phoenix & filed our divorce in AZ. My husband is going on medical disability & lives in CA. He is turning his pension into the disability. We have been married 19 years and the judge that I saw at my first hearing wants me to check the pension amount so I receive my correct amount. I have a request for $850.00 in spousal support but I would like to lower it to $450.00 because he is going on disability. I completed the decree with a paralegal. Can I change the decree myself to lower the amount of spousal support before my next default hearing?

Our duaughter will not let us see our 2 yr old granddaughter. This may sound petty, and it is. It stems from a year ago, when we told her and her husband that they had to move out of our house. They had been living with us For over a year, with no plans to move forward any time soon. They were taking advantage, and their pets and they were destroying our house. They had a new baby, and we took care of her while they worked, and we worked also.. The time came that we had to tell them to go, after our daughter became verbally abusive to me one day. My mother passed away. She does have a will and I was nominated as the executer and trustee. I am the sole beneficiary. She only has a bank account but when the account was setup nobody was on the account but her. no payable unpon death. What is required by the bank for me to access the account to begin paying for her expences? Her will did state that I shoud have immediate access without going through the courts.

My father passed away on 9/2/15 and I have been made the personal representative of his estate, he had a roommate living with him for 3 years that never paid rent. How do I go about notifying him he needs to move out once the house is sold?

My step son is 15. He has been with us for 16 months without seeing his biological mother. My husband is getting deployed in 2 weeks again, our son does not want to go back to mom being she has put him through alot.
