QUESTIONS

  • I work for a private Fiducairy Company in AZ. I have a client who is in a year lease at an apartment complex. He ended up in the hospital three weeks ago and his physicians are stating he cannot return home and must be placed in nursing care facility. The Apartment complex is stating he must pay next months rent and a $700.00 fee to break the lease. Are there any provisions or statutes in the Landlord Tenant Act that would help my client. He is on a fixed income and lives on his monthly VA benefits and Social Security. He does not have extra resources to pay for rent at the apartment and pay for a nursing facility too.

  • I am renting (with 3 months left on my lease) but am in the process of purchasing a home. I have requested to vacate the rental property early but will pay all remaining rent. Question: can the landlord legally require me to maintain the rental property (thru the lease date) even after I’ve paid all rent and vacated the property?

  • My husband was previously married in Puerto Rico and divorced there as well from his ex wife. Our previous visit at the legal office on post verified whether or not the ex spouse is entitled to any percentage of his retirement. The information given to us is that she is not entitled to any retirement when it occurs due to haven been married in Puerto Rico. We just want to confirm is this is certain? Thank you
  • My son-in-law sued for divorce from my daughter. Two kids are involved--16 and 11. His attorney (say Mr. X) has subpoenaed me to testify on his client's behalf. I do not want to testify. Q1. Does the fact that his attorney met with my wife and me c. 1 yr ago to discuss my daughter's issues as the relate to the kids disqualify him as having knowledge we gave in confidence to him? Q2. Does the same apply to my wife, my daughter's step mother? Q3. I have worked with both to provide a negotiated settlement, divulging information that may compromise her if I testify. Will this disqualify me?
  • My son asked to move his camper to my home. I adamantly told him NO. He knocked on my door 3 days ago and had moved it on my property while I was sleeping. He is not allowed on my property anyway due to his drug use. Now I have people in on out of his trailer buying dope. I don't know what to do to make him leave! Do I call the police or do I have to file an eviction notice on him? I am afraid of him as he has threatened both my life and to burn down my house if I didn't let him park it!   • I have lived in my park for 16 years, gone thru at least 4 management changes and decided to sell my mobile home and move. I have only ever signed the original lease, no addendums, have never been provided any new rules or regs, have continuosly asked to have my electric and water bills researched, and have NEVER gotten a response as to why when I lived away from the home for a month my water bill was $92. Now, since I have sold my home, the management company is coming after me for the last month rent and utilities. I requested a copy of he standing lease on my account and they refused.
