I let a friend move in with a verbal agreement that she would pay rent when she got a job - it has been a year and no job and no rent. Do I still need to go to court to evict her if she has never paid anything?

My minor granddaughter's father died in a car wreck in January, she was awarded the life insurance and workman's comp because it occurred on the job. I was out on deployment when my vehicles safety inspection sticker expired and my truck got towed from my parking spot at home and was impounded. I never missed a payment and could not afford to pay the impound cost when i returned home from deployment and Navy Federal credit Union would do nothing to help me get my vehicle back. That was back in 2009 i believe, and Navy Federal Credit Union has been trying to collect the remaining $7000 on the loan from me which i do not have and have never had. i do not even have a job right now. What can be done about this? i feel cheated!
