  • landlaw filed a eviction on me in 5 days after rent due date. I living there years without being late . I finally paid the rent and he tact on 200 more for court fees. we never went to court, he said he cancel court since I paid but he kept the 200, my land law never showed me the lease or any papers of evictions, or gave me a receipt , he always gave excuses questions I ask of him and many repairs he failed to do
  • My wife and I moved into a rental home on 3/1/18 in Tucson, Arizona, and almost immediately my wife and I started having breathing problems when inside the house. We do not experience any of this when outside the house. Upon my inspection, I noticed black mold inside and out of the guest bathroom toilet. The management company sent their maintenance person who after getting clearance (1 week) they removed and replaced the toilet. The odor was abated for approximately 2 days and returned with the entire inside of the house smelling musty. It is more pungent in the laundry room and master bathroom. I have found mold in the master bathroom toilet on the inside. I went to the Management Company on 3/22/18 to advise them we continue to find mold in the house and my wife and myself are having breathing problems, mucus and headaches when we are in the home. We are having no issues when we are not inside the home and outside at work or living our active life style. and to see if they would look into this and was advised it was on me and I should hire a mold technician check it out. If mold is found then the Management company would move on it. Why would I have to have this expense, it’s not my house, we just moved in and I feel this is the landlords responsibility. Can you please advise if there is any action I might take that would not cost a large amount of money to get the management company to do their job and do due diligence on this issue. Also, if you know of any agency in Tucson that controls these types of issues between Tenants and their landlords/Management Companies please let me know. Thank you.
  • I was married but separated at the time my ex got pregnant by another man. In the state of AZ the husband is presumed the father of any child conceived during wedlock. I am not the father but I also did not respond when child support was established because she told me that she was going to tell the court that I was not the father. My ex and I both know who the father is but she will not cooperate with getting a DNA test done what can I do?
  • I made a huge mistake by cosigning on a car loan for a girlfriend back on 09/15/08. She only made 9 payments on the vehicle then let it go back to the bank. It’s been almost 6-1/2 years since she made her last payment and now they’re coming after me, after all these years have gone by. I was told that Arizona Statute of Limitations A.R.S. § 47-2725 is four (4) years for auto loans. But their attorney is ignoring that and coming after me regardless. It's now October 2015 and they are coming after me for the loan amount + interest totaling $13,000 altogether. I'm retired and living solely on Social Security of $1,776 per month and two small pensions totaling $624 which = $2,400 per month. And I'm living with my daughter to make ends meet. Therefore I can't afford to pay theses people. I had an initial pre-trial conference on 10/8/15 and represented myself because I can’t afford an attorney. It was determined that there will be a trial on 12/14/15. I told the loan company in court “that I have no money and living on $2,400 per month and living with my daughter to make ends meet, and they’re still pursuing the trial date. My questions are: 1) Will the Arizona Statute of Limitations A.R.S. § 47-2725 four (4) years get me out of this mess completely? 2) I've been told and read online that Social Security income and Pensions “cannot be garnished”. Do you know if this is true? If it's true then I have nothing to worry about and won't need to file bankruptcy. 3) If I lose my case can I file bankruptcy on a judgement that's been awarded against me? 4) Can they levy / garnish my checking account where my Social Security checks and Pension checks are electronically deposited?   • I was served with a writ of restitution by my landlord, i currently own the mobile home and i was asked to leave within 5 days, but i own the mobile home so my question is what happends to my m.h after i leave, i was given the option to remove or sell it. Can i return if i have buyers interested in buying it or do the landlords automatically keep it?
