QUESTIONS

  • Collection agency sent a letter instead of summons, is this the proper procedure?
  • My lease for the condo I rent expires 07/31/10. if I move out in June, but still pay June and July's rent, am I considered abandoning the property? Do I need to let the landlord know I am moving out?
  • We were just informed by the landlord's property manager a week ago that the landlord is placing the house we rent up for sale but our lease will still be honored. We are into our lease now 5 months. The lease does not expire until Feb. 28,2020. We have requested from the property manager that we would like to terminate our lease and commit to a month to month status with the understanding that we as well as the landlord can provide a 30 day notice to vacate. We have found a home we wish to purchase and do not to be held to commitment now that they are selling the house. Please advise. CW

  • I recently rented a room for my wife and I from a couple in Phoenix. I paid a deposit and three months rent in advance totaling $1625. I received signed receipts. Before moving in the landlord changed our original agreement and asked for a separate fee for utilities. We had agreed on a monthly rent charge that would include utilities.I informed the landlord that if he could not adhere to our agreement I would remove my property and wanted a refund. After considerable difficulty I was allowed to do so but a refund has been refused. A lease was also refused. I never stayed in the home even once.
  • So my family and I moved into a house on the 1st of the year and the second week we were there the wall heater had just stopped working and I have been asking him to fix the problem all the way up to it catching on fire and now I dont know what legal actions I should take. Me not thinking at all never texted him about it but i had called him on multiple accounts telling him about it and showed up to his office to tell him to fix it. I just had a baby on the 22 of feburary and the fire happened on the 24 the day after we brought him to the house.

  • I have a signed lease agreement with two other undergrad college students. One has vacated the property and has requested that the Landlord approve a sub-lease. There is a modification clause stating that all party's must approve in writing any changes to the lease. Can the other roommate and the Landlord move anyone they want into the residence without the approval of the other two that are remaining? There is a sub-lease clause as well stating that a sub-lease may be granted with the approval of the Landlord.
  • We have not had a working toilet in our apartment for 6 days, who do we contact to get action.
