I am a landlord and my lease specifically states "Mediation then arbitration" My previous tenant has filed a Case in the Civil Small Claims court. Can they legally take me to court if the lease has listed Mediation and Arbitration over a going to court?

Do I have the right to with hold rent for days I wake up with no heat? I remember having same issues last winter. The heat is included in the rent, but that doesn't give them the right to not maintain it properly. I'm sure they will "fix" it again, but it will only be temporary, and I will wake up cold again in a few weeks or so.

paid application fee (30.00), and was approved during special of 99.00 per month advertisement. Contacted mgmt, then was told there was nothing available, requested return of 30.00 app fee (denied)told non-refundable. How can they take a app or a fee if nothing is available. When lot came available, because of timing had no choice but to take, but we were told rent was now 295.00 instead of 99.00 even after being approved at special offering but nothing available. Do I have any recourse, and now 7 months later 99.00 special is available. Any Help would be great. thanks for the help

My daughter is addicted to methap[hedomine and has temporaroly signed rights to me twice in the last 8 years ive had physical custody of my grandson. ive had him since age two hes now 10 and she wont give a notorized temp guardianship therefore i cant enroll him in wschool, cant obtain propper housing ,fiancial help ex... how do afford this im a widowed granmother with limited financial income but know that i provide much safer and loving atmospere than my daughter who basically abbandond my grandson what are my legal rights??? am I entiteled to help?? I want to retain custody of my Grandson .

Instead of sending rent directly to him, my landlord has had me mail my rent as deposits straight to his bank. I have been using automatic bill pay through my bank, so it's been a hands off process for all involved. He just hit me with a five day notice to pay or vacate, claiming he is owed $11,000+ since April of last year! Is there anything in the law that protects a tenant from a landlord claiming non-receipt of payment months later if my payments in fact were lost and cashed by a 3rd party as it seems to be in this case? I have a 3plex in AZ that is about to go into foreclosure. I was told by an Attorney that if the lender does not come after us with in 90 days of the foreclosure date by law they cannot come after us in other words sue us. Is this true?
