I am defending myself in a case. I have a witness who gave a recorded statement to my insurance company. The witness gave permission to my insurance company to release the recording to anyone wishing to investigate the incident. Can I use this recording in court as evidence? Does the witness need to be present in order for me to use the recording? The witness may not be able to appear in court and that is why I am asking.

My daughters father has been absent for 5 years. He had a prior court order that allowed him visitation over 5 years ago. He completely stopped taking her or picking her up. Has not contacted her or I since then. She is now 8 and he now wants to see her again and wants shared legal etc. He is also now engaged and had a 2 year old. My husband and I have been married for 19 years. Common Law for 4 years and 14 years Legally Married (State of NM). We have been separated for 3 months, if I decided to divorce my husband my reason is "Adultery". We have a State Marriage Licence and we married in Navajo Nation Court. Do I file with the State of New Mexico or Navajo Nation. We have 2 children therefore child support will be filed. And can I charge my husband and his companion with "Adultery"?

I currently live out of state with my children. My ex's lawyer and him have manipulated the truth and twisted things around to make things go in his favor knowing I would not be able to afford the legal counsel to continue the fight. Can I somehow stop him from using that lawyer in the future? How can I find a lawyer now that my family and I are tapped out and we are still paying legal fees? We still have several issues and I would like a mediator/lawyer to correct things however, I do not know where to start now that we are in another state and I can't afford legal counsel. What do I do?
