Hi! I am one of the very lucky people to be granted a new trial. There was an error at trial and the judge ordered a new trial. My question is what happens at a retrial? Is it the same testimony from the first trial or can the victims change their story? For example, the victim admitted hitting me first during the first trial. Can he change that or does testimony have to be the same? I need to know this to help make a decision regarding accepting a plea offer. My attorney is unsure.

I have received tax bill from the IRS for $630 plus charges of $284 from 2011 I have no money except my SS- $725 plus food stamps and cannot pay and I am just over a bout of throat cancer treatment and can not work or add to my income so find it impossible to pay the tax and the penalty can you point me to some one who can help me.

How can we separate finances during our sepatation? I want to buy a house of my own with out obligating him or puting myself at risk of it being considered community property. He has moved out and our home is up for sale.

My ex's visitation is every other holiday break and half of the summer. He disappears for months at a time, last time being 4 months and he was in jail; he is also far behind on his support. He now wants to have them for the summer in TX. I have qualms about it because the last time he took them out of state, he didn't bring them home, I had to figure out a way to go get them. Additionally, the last time he had them here for their break, he had me pick them up after 6 days because he couldn't handle it. Can I legally deny him visitation out of state?

My late husband incurred a car repair shop debt before we met. After he died, I started getting letters from an attorney for the shop saying I was responsible for the bill now. Is this true?

I am expecting a baby 8/1/11. The father & I are not married nor are we cohabiting, but we get along. What is the basic process for establishing custody and parenting time? Are we legally required to file something through the court? If so, how? I don't care how often he comes over to see us but his work schedule is unpredictable, so a pre-scheduled parenting time arrangment might not be feasible. How formal does a parenting agreement need to be? Are there flexible options available?

I read a similar but not exact question, so I'd still like to ask one. My son's biological father & I went through a custody case in 2013. He was granted extremely limited parenting time, but (for some reason) joint legal decision making. It's now been almost 2 years and we haven't seen from or heard from him. I recently moved into condo. I recieved notice from the HOA stating that my dog is over 30 lbs (which is apparently not allowed). However, both the realtor and landlord approved of me having my dog which is specified in our lease agreement. Can I be asked to leave?

I was recently in a relationship with a guy who was verbally and emotionally abusive. We were living together for about 3 months and he was always yelling at me and I was getting very scared. After he held me inside our apartment and refused to let me leave I finally got out and moved out. I tried to keep things civil. He moved to out of state but he says he will come back. He calls the house I am staying at several times a day.  He breaks into my emails and talks to my friends. He threatens me and he gets very angry at times and calls me and says he will do stuff to me and he will do stuff to my friends . I was wondering what I could do. I am very stressed out and scared and I feel like it is getting worse and I need a solution. I looked up about an order of protection but Im not sure where to go and how to do it. Id like to stop him from contacting me, my family, and my friends. I feel that he may be emotionally unstable and have issues that could turn to violence. He says he is coming back to Arizona and I just want to protect myself, my family, and my friends.
