QUESTIONS

  • While I was out of town, my apartment had a sewage backup, and subsequent mold infestation. Tenant was notified of the uninhabitable condition on Dec 11, met me at the property on Dec16, and offered to replace carpeting with tile. I provided written notice of uninhabitable condition on Dec 16 as well. I'd like to know several things: 1) do I have a right to demand mold inspection and remediation? 2) landlord has suspended rent as of 16th, but am I entitled to storage, moving, and/or living expenses while repairs are being completed?
  • We currently have a mortgage on our home as well as a home equity line of credit. If the first mortgage company forecloses on our property, can the bank that we have a home equity line of credit sue us or file a judgement on us for the amount of the home equity line of credit we used?
  • Does the Late Fee Fairness Amendment Act Of 2016 also apply to mobile home park owners? I own my mobile but rent the lot. My landlord charged me a late fee on a late fee, but all of my rent has been paid on time. They claim that they can't apply my rent check for Dec. because it's not the full amount of my account, which includes the late fees. The late fee was because I was disputing the water bill and wasn't paying until we were able to speak about it on the phone, which was past the date that rent is due. They said they would waive the late fees, then reneged.
  • My husband passed away and had a credit card that was in his name only. Am I held accountable to pay that debt off? And I am confused, do creditors have six months to file a claim, after they receive the death certificate, or 6 months after you probate? Thank You!
  • I live in a Mobile Home Park. I got a sink hole behind my house after a really bad storm. The water pools between the houses and when it drained, you can see the trail of debri that flowed to the back of my house where much of the water washed out the soil and left a big sink hole around my cement slab that my AC sits on. I only rent the lot. Does the park need to fix this problem or am I suppose to fix a new sink hole every time we get a big rain storm?
