My mother remarried when I was 2 years old. My brother and I both were enrolled in school using my stepdad's last name even though our last name was still legally our birth certificate name. I got married using stepdad's last name. My mother, real father and brother are all deceased and even though I have a certified copy of my birth certificate I am having a hard time proving that it is me, since I never used that last name. I am 65 years old and have had my driver's license since I was 16, moved to Arizona last year but cannot get my license/passport. What can I do? Terry Jaynes

Can i deny court ordered visitation if my childs safety is a concern? ie. my children were victims of child abuse and they just informed me that the abuser has been living with their mother within the last few months and she has allowed this with my children there during her scheduled visitation. my younger child does not feel good about this arrangement and stated he was not comfortable being around this person and that the visitaions have been different. i feel that this is not in their best interest so therefore i did not allow the visitation.

My boyfriend is 18 and was arrested yesterday for level 2 burglary,battery and Theft . he has never been in trouble. I am really scared. I dont want him to go stay in jail . what do you think will happen?

Are there any resources that provide free or reduced cost defense for criminal misdemeanors in Phoenix? I cannot afford an attorney since I have been living pay check to pay check trying to pay off a $3000 title, but I do not qualify for a court appointed attorney ( bc state not seeking jail time) and do not qualify for any of the reduced/free legal aid programs on this site since without deducting bills I make about $2000 a month. Please help, as I do not want to defend myself at trial for criminal matters alone. It seems so unfair and unjust.

I made a huge mistake by cosigning on a car loan for a girlfriend back on 09/15/08. She only made 9 payments on the vehicle then let it go back to the bank. It’s been almost 6-1/2 years since she made her last payment and now they’re coming after me, after all these years have gone by. I was told that Arizona Statute of Limitations A.R.S. § 47-2725 is four (4) years for auto loans. But their attorney is ignoring that and coming after me regardless. It's now October 2015 and they are coming after me for the loan amount + interest totaling $13,000 altogether. I'm retired and living solely on Social Security of $1,776 per month and two small pensions totaling $624 which = $2,400 per month. And I'm living with my daughter to make ends meet. Therefore I can't afford to pay theses people. I had an initial pre-trial conference on 10/8/15 and represented myself because I can’t afford an attorney. It was determined that there will be a trial on 12/14/15. I told the loan company in court “that I have no money and living on $2,400 per month and living with my daughter to make ends meet, and they’re still pursuing the trial date. My questions are: 1) Will the Arizona Statute of Limitations A.R.S. § 47-2725 four (4) years get me out of this mess completely? 2) I've been told and read online that Social Security income and Pensions “cannot be garnished”. Do you know if this is true? If it's true then I have nothing to worry about and won't need to file bankruptcy. 3) If I lose my case can I file bankruptcy on a judgement that's been awarded against me? 4) Can they levy / garnish my checking account where my Social Security checks and Pension checks are electronically deposited? I have had my grand daughter since september 2015 and now her mom is wanting her back in June, how do I go about getting guardianship of my grand daughter, my daughter does not live in this state and at the moment she is living with friends, she also has 4 other kids who are constantly being taken out of school and moved around at the moment none of the kids are in school, I really don't want to send her back, she is autistic with other disabilities and is doing good here although we have our moments and she is in counseling, I don't even know if I even have a chance to gain guardianship.
