I'm not happy with my marriage and my husband is saying he is moving out and he is taking our 5 year old from me. Possibly moving to Indiana. My background isn't perfect, mostly drug charges from the past. He will try to use it against me. Can he legally take my son. With out my knowledge. And if he dose move out, can I go take my son back. Can he take him, or is it kidnapping. What are my rights?

Does an email exchange between landlord and tenant constitute an agreement to extend a lease or does there have to be a new lease signed for the additional time to be valid, or if no new lease then is it considered month to month?

my son died 10/22 he's never married and had no children. What form do I need to fill out to assume/satisfy his auto loan. The value is 22,998.00 with 17,200.00 still owing on the finance contract. He owned nothing else of any value. Will a notarized affidavit for collection of all personal property suffice and if so do I need to provide it to the court as well as the finance company? Thank you

Let me try this question again. I have been granted a new trial. I do not need to know how to motion for a new trial. At the new trial, how does it go? Will the testimony be the same or can victims and witnesses change testimony? Is a new trial just a rehash of the same testimony with a new jury? Thank you!

while working on a modification, my home of 17 yrs was sold at auction. Pls help me understand what my rights are. Note taped to my DOOR saying who the "new" owner is and I have to be "out in 3 days" please give me a direction, my son is disabled and lives w/me (25) I truly have no where to go and am in such an emotional wreck I cannot stand it. How can this be legal? How can a home be "sold" while they are "working on modification"? Pls assist me in whatever way you can. thank you.

My daughter and I leased an apartment 2 weeks ago. The police served an arrest warrant on my daughter's friend who was visiting our apartment yesterday by forcing entry into the apartment and also conducting a search of the entire apartment. The police told me this was in reference to an ongoing criminal case against this person. I am concerned that we will be evicted even though we had no idea that her friend had a warrant for his arrest and do not have any idea why it was served at our place of residence. Should I speak with the management to proactively avoid any type of repercussions?

My children are 15 and 9. I would like to take us on a trip to Europe. When looking at the passport papers it says I need the "other" parent to sign off on Form DS-3053, consent for a minor child to get a passport. My children's father hasn't had ANY contact with them in the past 9+ years. Is there a way around this? Can I file something with Arizona court? Doesn't the length of time count as abandonment by him? Thank you.
