QUESTIONS

  • My significant other and I have a child, we are not married, nor is there any court order in place in regards to child custody. We have been living together in CA for the past 3 years and I want to move to AZ with my child without her. Do i need her permission to do that? I have already planned on filing for sole custody once i get to AZ.
  • I have a signed lease that states my rent is $680 for my student apt. Before moving in the apartment was changed and the new rent became $50 more per mo. I paid this, but never signed an adendum to the original lease - this is my first apt rental. Do I have any recourse to ask for the $50/mo back (now totaling $250) since the amount was never part of my lease or because I paid it, does it mean implied acceptance and binding. They are charging me a break lease fee and I'm trying to get them to come down on the amount. I feel I was taken advantage of since I'm young.
  • Our leasing company who operates nation wide told me their contractors are legally obligated to tell them if they see or hear pets. (We don’t have one but our neighbors does, these houses are squished together) now they are trying to force fees with out me signing anything. It feels like an invasion, one of these dates this has been “recorded” was today while I’m at work. We haven’t requested for anything to be fixed. Is this legally allowed?
  • I signed a 7 month lease which was up on July 4th. I asked for an extra month after my lease expired and they said, no problem. I went in to pay this months rent and they ask me to pay almost $300 more for the extra month. I told them I was not told of an increase in rent and I don't have the extra money for this. Is this legal for them to raise the rent without any kind of notice? They also put a 5 day notice on my door.

I decided to split our share, my 1/2 of the house (it was paid off by my father as a gift). I tried to get refinance-get the house-give her money 1/2 -and she was too BUT both of us fail to secure the loan we need. On 15 Oct. 09, I ask a realtor to sell our house so I can get my 1/2, her 1/2 but she repulsed to sign the sale auth and still live in it until now. What can I do to have her sign the sell, get my 1/2 and give her 1/2 so I move on?

  • Does a California judgment creditor HAVE to file the judgment in Arizona to garnish my wages here in AZ? The law I found ARS 12-1702 uses the phrase “may be filed in the office of the clerk of any superior court”. It doesn’t say where it says they must. If they must and have not what would be my next step in stopping the garnishment? Thank you
  • My home was in the middle of probate when they sold it so prior to bank sold it to company and because there wasn't somebody legally responsible for the loan hence I had to probate it before anybody at company would discuss it with me, and they granted me executorship a week after the sale. I then had a stroke and was in hospital, court papers scheduled in a few days to go to court. I want to keep my house of 17years what can I do? Please help fast.
