QUESTIONS

  • When is it NOT LEGAL to terminate an employee; i.e., what are the grounds for termination of employment that the law prohibits?
  • I live in an HOA where the board wants to change the CC&Rs to start requiring homeowners to provide deposits for several things, such as bringing in dumpsters. I reviewed Title 33 and the only place where I see they can require a deposit is for remodeling a main house (33-1817.B) in order to make sure the remodel complies with approved plans. ARS Title 33 is clear that the HOA can assess fines and assessments but, other than this one instance, it does not say they can require deposit. Are they allowed to do this?
  • My mother has contacted an attorney that I had befriended and still keep in contact and use on occasion for legal issues. My younger brother has been doing home improvement projects for this attorney for several years now but has never retained. There has been an argument between myself and another family member (making false claims) and this attorney has been counseling them. Is this a violation of ethics? How could a friend/attorney represent another family member against me. This attorney is too closely related to our "business" and appears to be a HUGE CONFLICT... Please advise ASAP
  • Signed a lease agreement a few weeks ago to an apartment sight unseen due to current resident. Today, my wife and i received keys to the new apt. Immediately found a roach infestation. In every room and every corner, black and german roaches coming out of the walls. Not one thing has been moved in yet and we were in the apt for about3 minutes. Can we legally terminate and/or nullify this lease pre move in, due to health concerns with our newborn? I have video of the roaches crawling everywhere.
