QUESTIONS

  • I never married my son's father. We have agreed that he stays with me Sun pm through Thur am. Thur am through Sun evening he stays with his father. His father has been very confrontational with me on several occasions when he picks him up. The pick up/drop off location is my parents house because it is a halfway point. I also have witnesses on how he treats me. I am concerned that he will use the fact that he works for the AZ DOC to gain credibility over me and try to take our son from me simply because he is angry with me. What legal action can I take to ensure that he abides by our agreement

  • My apartment is flooded from a leak in the roof. They had someone here earlier to try and locate the problem, but now the floor is saturated(carpet and the paint is bulging on the ceiling and the wall from water underneath. Can I move into other housing until it's repaired? They didn't even bring a fan over, and its getting wetter and wetter, I'm afraid that mold will start growing because It is very hot here, perfect for growing mold in wet plaster.
  • I am purchasing a house and terminating my lease on my apartment early . my landlord wants $1285 for a lease breaking fee. Is that legal?
  • I moved out of my rental home 2 months ago, 6 months prior to my leasr end date. It was agreed upon mutually by myself and landlord that I could break the lease, as the home was in short sale and an offer had been made on the hone. Today I get an email from my landlord stating that the short sale did not get approved and they are asking for me to pay to have the carpets cleaned, both the front and backyard landscaped and the home cleaned. First off, the home was cleaned when we left and the yard was fine. Can they ask for this to be done 2 mos later because their deal fell through?
  • The home we are renting is set to go to Trustee Auction at the end of this month. The "Protecting Tenants at Foreclosure Act" expired 12/31/2014. What are my rights as a tenant now that this has expired. Can I be evicted without notice..do I still have to receive ample notice if the new owner wishes to occupy the home?

I have reached the end of being taken advantage of. She gave notice of 18 days I accepted can I boot him like I should have?

  • The law provides that if my landlord does not return my deposit less deductions within 14 working days they are liable for damages of twice the amount of the deposit. Does that prevent the landlord from having any deductions at all?
  • I was arrested in January of 2019 in Gila county, the preliminary hearing was vacated and I am not being charged but when a background check was done the charges were found. I am trying to re-enter military service, is there a way to make these go away since the state is not pressing charges and it’s been the better part of two years, what are my options?
