Question: i owe 20k in child support through DES but mom is stating that i am not the father. If i get a paternity test and am proven not the father, will i still have to pay the back owed support?

Answer: Arizona Revised Statutes, Section 25-503 (F) states:  "On petition of a person, who has been ordered to pay child support pursuant to a presumption of paternity established pursuant to section 25-814, the court may order the petitioner's support to terminate if the court finds based on clear and convincing evidence that paternity was established by fraud, duress or material mistake of fact."  That means the burden is on you to obtain the paternity test and file documents with the court to establish that you are not the child's father.
