Question: My husband and I have been living apart for over a year. He left when I was 3 months pregnant. Right now we are going through a divorce. He is not paying child support. Will the court order that he pays back child support? He also has not pais medical bills resulting from birth. paid some child support, than stopped.

Answer:

If there is a court order requiring your husband to pay child support, then your husband is still responsible to pay you those payments that he missed.  If there is currently no child support order in effect, a person can request that temporary orders for support be established.  (This would require your husband to pay child support to you during the time that the divorce action is pending.  Temporary Orders can also designate which spouse is responsible for payment of certain bills while the divorce action is ongoing).
