Question: My wife and I are living separate and have divided all of our assets and financials. Also we signed a contract to protect one another. Will this hold up in court if we decide to get divorced later?
Answer: I am not sure what you mean by a contract to protect one another. Are you talking about holding one another harmless for the debts of the other spouse? If so, such a document, if properly executed, is enforceable between the two of you but not against creditors for community debts. It would be in your best interest to talk about this with a lawyer. There are 3 programs in Arizona that you can use to get some inexpensive legal advice and guidance. One is the Modest Means Program. If you are financially qualified for the program, for a $75 fee, Modest Means offers a one hour consult with an experienced attorney.
