Divorce & Annulment

questions & answers

Question: My husband and I are going through a very civil divorce. We have no kids and want to be officially divorced as soon as possible so he is able to purchase a house without my liabilities. Once we turn in the paperwork, how long will it take for it to be processed?

Answer:

Each divorce is different. Timing of a divorce action can change depending on the complexity of the divorce/assets and the amount of assets involved. Generally, you may want to review A.R.S. § 25-329, which discusses a waiting period for the court in dissolution proceedings. That statute states: The court shall not consider a submission of a motion supported by affidavit or hold a trial or hearing on an application for a decree of dissolution of marriage or legal separation until sixty days after the date of service of process or the date of acceptance of process.
