Question: My Ex husband was arrested for felony domestic violence in another state with his new wife. He and I share 2 children together and I am very concerned with my child's well being. Can I file emergency orders against him for full custody of my kids?
Answer: A person may file for emergency child custody orders if they believe that someone is about to cause "serious, immediate bodily harm" to the children or "the health, safety, and welfare or a person is in serious and immediate danger." If you feel as though one or both of these is true then you may file an emergency petition. Emergency petitions can be located through your courts local Self-Service Center.
