Question: What do I do if my spouse filed a domestic violence claim against me wrongfully? I have been out of the house for 3 weeks because she is the one who was abusive.
Answer: Your question is not specific. Did she file an order of protection against you which precludes you from having any contact with her? Did she have you arrested for domestic violence? If it is an order of protection and you have not been arrested, you have the right under Arizona Revised Statute, Section 13-3602 to submit a written request to the court issuing the order and ask for a hearing where you will have an opportunity to present evidence that you did not commit domestic violence. If she has filed criminal domestic violence charges, you are entitled to an attorney to represent you. In that event, you should ask your lawyer about your options.
