Question: I have a daughter who turned 16 at the end of the Summer. I went to court over support modification and visitation. She did not want to spend this past summer with me and the judge conceded but said she will spend the future summers with me. I live out of state and my daughter said she wants to spend the summer next year with her friends in Arizona again. Can I emancipate her if she refuses to see me?

Answer:

No, you cannot emancipate your daughter for refusing to see you.  The Arizona law that discusses emancipation says " a minor who wishes to be emancipated may file for an emancipation order with the clerk of the court in the county in which the minor resides if all of the following apply". 

The laws on emancipation can be found at A.R.S. §§ 12-2451 through 12-2456.
