Guardianship of Minor
questions & answers
Question: I need to know if all petitioners on a guardianship application must appear in court. We are filing for guardianship of my almost 18 yr old son with Down Syndrome.
Answer: For assistance with your specific situation, consult with a licensed attorney. There is not a particular provision that states all petitioners must attend the court hearing. When a petition is filed for guardianship, all interested parties must be notified. After parties have been notified they can choose to waive their rights to appear in court. If an individual will not be in court, they may want to sign a waiver.
