Question: Can an order to appear be filed before the petition is actually served?
Answer: The order to appear can be filed. Service process is required for the person that is ordered to appear (respondent). If the whereabouts of the person ordered to appear are unknown, or the person avoids service, publication is sufficient for notice under the Arizona Rules for Civil Procedure (4.1 I).
