Question: I'm 78 years ol my 50 year old son lives with me. There is no lease signed but I want him out he does not help with bills. Can i throw him out of my house.
Answer:
The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly. This situation depends on whether or not there was an express or implied agreement for how and whether an occupant may be removed from the house. If there was an agreement, he may be considered a tenant and subject to eviction proceedings. More info on that may be found here. However, if the person is only there on a permissive basis, he is considered a trespasser if he fails to leave when asked to do so, and may be subject to ejectment. If needed the police may help with ejectment. Depending on the circumstances the occupant's rights may be different, so it is best to consult with an attorney.
