Question: I am a divorced father of two children. I provide insurance on my kids and the ex provides medicaid on them. Recently she chose a Dr that doesn't accept medicaid. Who will be resposible for paying the balance owed? My insurance is court ordered.
Answer: The following is provided for general information only. To find out how the law applies to a specific situation, contact an attorney directly. According to the Arizona Child Support Guidelines, starting on page 7, in a child support order the court shall specify the percentage that each parent shall pay for medical costs not covered by insurance. The guidelines go on to say that both parents should use their best efforts to obtain services that are covered by insurance. Also, any request for repayment or reimbursements of uninsured medical coverage must be provided to the other parent within 180 days after the service date.
