Answer: Arizona has a very strong policy against driving while under the influence. As a result, it has established a statutory scheme governing the prosecution, proof, and punishment of DUI offenses. The punishments for DUI offenses are more severe for subsequent offenses. If a person is convicted of a DUI offense, the court is mandated to impose a harsher punishment if the convicted defendant has any prior DUI conviction within the previous seven year period. A.R.S. 28-1381(K). While this is not a limitation on how much history may be brought to a court’s attention during trial, it is the limit for imposing a mandatory increased punishment.
