Question: if i have priors in the state of california that occured in 2005 and 2008 can the state of arizona use that against me in court

Answer: I am assuming you are referring to felony priors. It would depend on the date of the offense in Arizona, and if it was within 7 years from the priors in 2005 and 2008. If it was beyond the 7 year period (which really would only apply to the 2005 prior), then it cannot be use to automatically enhance a sentence, however, can be used to impeach you if you testify, and can be used as an aggravating factor in determining a sentence. Also, if it is an Aggravated DUI prior, and is substantially the same statute as the Arizona statute, it may be alleged up to 10 years.
