questions & answers

Question: I got arrested on October 12 2014. I did not receive the summons to appear in court on November 19th. now I have two warrants out for my arrest if I turn myself in will I have to stay in jail or will I be released that day

Answer: A fugitive surrendering to law enforcement pursuant to an arrest warrant generally receives the same consideration for bail as any other arrestee. A variety of factors could prevent the surrendering person from securing bail after an initial appearance in front of a magistrate judge following arrest. See A.R.S. § 13-3961. These factors include the specific offense(s) charged, the person's criminal history, the type of victim, and the person's risk for flight after bail. Simply surrendering to law enforcement pursuant to an arrest warrant does not ensure that a court will grant a person bail. For fact-specific information and advice, please consult an attorney.
