Question: I was arrested for driving on a suspended license nov. 2014. They just filled charges on 8-2015. I was taken to the station where he was going to cite and release me. He started to search my purse in which he found dangerous drugs. I did not know it was in my purse. but where he found it went beyond just frisking. Is this correct procdure when being arrested on a traffic violation?
Answer: In general the 4th amendment protects you from unlawful search and seizures. An unlawful search and seizure is normally considered one without a search warrant, but there are exceptions. It may be wise to consult with an attorney in regards to your specific situation to see if an illegal search and seizure took place.
