Question: My 17 year old son has received a subpeona to testify as a witness against his friend charged with aggravated assault. My son does not wish to testify. What are his rights and what are the possible consequences if he chooses not to testify? We plan to show up in court but he plans to refuse to answer any questions.
Answer:
If a person is served with the Subpoena and fails to show up for the court date, that person may be found in contempt and be arrested and brought before the judge. You may want to meet with an attorney before any scheduled court date in order to see how the laws apply to your son's specific situation.
