Question: My friend's father passed and had no will. Where do I send him for help in dealing with the transfer ownership of the car motorcycle and other property his father left behind? What paperwork besides a death certificate will he need?
Answer:
.A.R.S. Section 14-3971 (the Small Estate Exemption”) exempts the decedent’s personal property from the probate process if the total value of his/her personal property, including vehicles, does not exceed $75,000 and other requirements are met. The claimant/person entitled to receive the personal property can contact the court for the county in which the decedent died for forms and instructions. The Arizona Motor Vehicle Division will process vehicle title transfers through this procedure, as well.
